      KAUKAUNA LAND MARK GONE.
      Another Pioneer of 1848 Departs!

      Martin Gerrits, Esq., a man prominent and widely known, who was born in Holland July 31, 1822, departed this life at his residence in Little Chute, March 3d, about five P.M. after a few hours sickness, leaving a widow and seven children. He was buried at Little Chute on the 6th inst., and not-withstanding the bad, almost impassible condition of the roads, a surprising large concourse of people attended the funeral after the usual religious ceremonies were performed.

      From the time of his arrival at Little Chute in 1848, Martin Gerrits was always greatly esteemed. He was thoroughly educated in English, Holland and French, was friendly and courteous with everybody, and therefore popular, and has always been prominent in town and county affairs. He has held various town offices; for instance, Assessor, Treasurer and Chairman, and for many years Justice of the Peace, which latter office he held at the time of his death. He was also for a term each, Clerk of the Board of County Supervisors, (now County Clerk,) and County Superintendent of Schools. He was a man noted for his integrity, and for his liberal and genial qualities, his heart and hand being always open, and his friendship ever enduring. His death will be universally regretted.
    • GERRITS, Martin was born in Holland in 1822; in 1848 he came to this country and settled in Little Chute the same year, where he resided until ihs death. He was married to Elizabeth Gisbers in 1851; Mrs. Gerrits died in March, 1895; they have 13 children, seven of them died previous to 1882. Linda Gerrits was married in 1884 to C. H.L. Hamer, who is now and has been for several years clerk of the city of Kaukauna; they have 2 children. First child, Peter Gerrits born in 1861. Second son, John Gerrits born in 1862; married to Mary Smith in 1892. Third, Minnie Gerrits, born in 1864; married to John Lamers in 1886; they have 5 children. Fourth, Fred Gerrits, born in 1868. Fifth James Gerrits, born in 1869; married Dora Peters in 1892; they have 1 child. Martin Gerrits was a prominent citizen; he filled several town offices with great ability and taught school in Little Chute many years and was much respected by all his neighbors. On reading and filing the petition of Elizabeth Gerrits of the town of Kaukauna in said county representing among other things that the said Martin Gerrits lately died at Little Chute in said town of Kaukauna. That at the time of his last sickness he made and pronounced his Nuncupative Will in manner provided by law, wherein said petitioner is named as sole legatee and praying that the proof thereof be taken and the same allowed and admitted to probate as the last will and testament of said Martin Gerrits deceased and that letters of Administration with the will annexed be thereon issued to Elizabeth Gerrits.

      It is ordered that said petition and proofs of said alleged nuncupative will be heard at a Special term of said county court, to be held in and for said county at the probate office in the city of Appleton, on the second Tuesday, being the 11th of April A. D.1882

      It is further ordered that notice of time and place of such hearing be giving by personal service on all parties interested, residing in said county, at least ten days before the time appointed aforesaid, and by publication of such notice at last three weeks successively previous to said time in the Appleton Crescent a weekly newspaper published at the city of Appleton in said county Dated Appleton March 8, 1882.

      Order appointing Guardian Ad Litem

      STATE OF WISCONSIN, IN COUNTY COURT,
      OUTAGAMIE COUNTY,
      At a Special term of the County Court within and for said County of Outagamie, begun and held, at the Probate office, in the city of Appleton, on the Second Tuesday of April , A. D. 1882.

      Present, Hon J. E. Harriman, County Judge.
      In the matter of Estate of Martin Gerrits, deceased.
      The petition of Elizabeth Gerrits for Proof of the Nuncupative Will having come on to be heard at this term; and it appearing that Peter Gerrits, John Gerrits, Minnie Gerrits, Fred Gerrits and James Gerrits of Little Chute, in said County are minors, and interested in said matter, and have no general guardian and John Botteusek, an attorney at law of the city of Appleton, said county, having consented to act as special guardian for minors.

      It is ordered, That the said John Botteusek be, and he is hereby appointed special guardian for said minors, for the sole purpose of appearing for them and taking care of their interests in the proceedings and said petition.

      On reading and filing the petition of Elizabeth Gerrits of the town of Kaukauna in said county representing among other things that the said Martin Gerrits lately died at Little Chute in said town of Kaukauna.

      In the matters of the proof of the Nuncupative Will of Martin Gerrits, deceased-
      Case called at 10 o'clock a.m. - Elizabeth Gerrits widow and Lena Hamer daughter appear in person.
      John Botteusek atty appears as guardian ad litum of the minor heirs of said deceased.
      Lena Hamer sworn says I am the daughter of Martin Gerrits deceased and reside at Little Chute Out. Co. Wis. - My father died March 3, 1882 at his home in Little Chute. He was sick from about noon until about 5 o'clock same day when he died.
      I heard father say where he wanted his property to go to after his death. He said I give it all to Beth. = My mothers name is Elizabeth and he always called her Beth. = Mother said to him now there is no papers made. He said everything was hers - I was right by him when he said those words. I had been in the room about 3 minutes when he used those words - There were in the room besides myself - Minnie, Freddie, John, Peter, James, and Mother and my husband C.H.L. Hamer

      John Gerrits sworn says I am the son of Martin Gerrits deceased - and reside at the Little Chute, Wis and 20 yrs next May - was present at the time of my fathers sickness and death in March 1882 = He was sick about 5 hours from 11 a.m. until 4:30 p.m. he died between 4 and 5 o'clock p.m. I heard him say to where he wanted his property to go to = He said I give Everything to you Beth.
      Mother asked him. Martin will you give everything to me - He said tell Constantine to come up make the papers - Mother asked him just before he died if he make everything to me and he said year: He said I give everything to you Beth.
      At the time father made these statements he was of sound mind, he did not say anything he was in such
      pain = He said Boys give everything to mother. This was before Constantine got there.

      Minnie Gerrits: sworn says I live at Little Chute = Martin Gerrits-died - was my father - he died at his home at Little Chute 3rd day of March about 4:30 p.m. I was there all the time he was sick about the house. He was sick after 11 a.m. to 4:30 p.m. He said something about

      his property while he was sick = I think it was in after about 3 o'clock -I heard him say something about his property two or 3 times.

      The first I heard him speak about his property was to send for Constantine. He said Constantine was to make the papers that everything is yours Beth = you heard that children = Mother said then is no paper made - He said everything is your Beth you heard that Boys John and Fred were present = Constantine Hamer was there at that time. My mother name is Elizabeth Gerrits = father always called her Beth =

      Peter Gerrits sworn says I am 21 yrs old April 1882 = am son of Martin Gerrits deceased, live at Little Chute Wis with my mother = father died at his home in Little Chute.
      He never wrote out a will. He was sick for ll:30 a.m. to 4:30 p.m. he suffered from a good deal of pain =
      I did not stay in the room a half minute = I was in the room about 4 o'clock, Constantine Hamer was there at that time - My Mother said Martin is it all mine? "Yes it is all yours Beth" "Do you hear that Boys" = Father knew everything he said.

      Nuncupative Will of Martin Gerrits, of Kaukauna Outagamie County, Wisconsin
      Everything I have I give to you Beth (meaning Elizabeth Gerrits wife of said Martin Gerrits).

      The above nuncupative Will was made by Martin Gerrits in the house and home of said Martin Gerrits in the town of Kaukauna Outagamie County, Wis where he was a resident for many years immediately preceding on the third day of March 1882 at the time of his last sickness which sickness was sudden and unexpected occurring on that day and which nuncupative Will was made just prior to the death of said Martin Gerrits on said day, in the hearing and presence of John Gerrits, Minnie Gerrits and Frederick Gerrits, C. H. L. Hamer and Lina Hamer, the said Martin Gerrits being there of sound mind memory and understanding and of lawful age. Attest this 7th day of March 1882

      In the matter of the estate of Martin Gerrits deceased the matter of hearing the proofs of the alleged nuncupative Will alleged by Elizabeth Gerrits as the last will and testament of Martin Gerrits deceased, having come on to be heard at this time of said Court and it appearing that due notice of the time and place of such hearing has been duly given as required by the order of the court hearing made on the 8th day of March A. D.1882.
      And the said for present having appeared and John Botteusek guardian ad litum for Peter Gerrits, John Gerrits, Minnie Gerrits, Fred Gerrits and James Gerrits minor heirs of deceased, appearing for them and Lina Hamer one of the heirs of said deceased appearing in person.

      And Lina Hamer, John Gerrits, Minnie Gerrits and Peter Gerrits - Witnesses to said alleged nuncupative Will having been produced, sworn and examined, and the witnesses and evidence produced by the parties having been heard, and upon consideration thereof the Court finds: That said Martin Gerrits died at his home in the village of Little Chute, in said county, on the 3rd day of March, A. D. 1882.

      That at the time of his death he was an inhabitant of the Village of Little Chute, said county of Outagamie.

      That on the 3rd day of March A. D. 1882 the said Martin Gerrits was of full age and sound mind. That at the date last aforesaid the said Martin Gerrits, deceased, was ill with his last sickness, of which he died as aforesaid, and was in the house of his habitation where he had been resident for the space of ten days or more next before the making of such will.

      That at the time of his last sickness, and on the day last aforesaid the said Martin
      Gerrits made his nuncupative Will by speaking the testamentary words following to wit: "Everything that I have I give to you Beth" (meaning Elizabeth Gerrits, his wife).

      That at the time of speaking said testamentary words the said Martin Gerrits did bid John Gerrits and Peter Gerrits person who were there and there present to bear witness that such was his will, or to that effect, and that said testamentary words are proved by the oath of three witnesses who were there present, to Wit:
      Lina Hamer, John Gerrits, Peter Gerrits, Minnie Gerrits. That the said testamentary words or the substance of said testamentary words, were reduced to writing by C. H. L. Hamer within six days after the same testamentary words were spoken.

      Therefore it is ordered and decreed that the said testamentary words, as herein above set forth, be approved and allowed, as the nuncupative Will of said Martin Gerrits deceased.

      Now Therefore, if the abounden Elizabeth Gerrits do and shall make and return into the Probate Registry of said Court, within three months, a true and perfect inventory of all the goods, chattels, rights, credits and estate of said deceased which shall come to her possession or knowledge, or to the possession of any other person for her and out of the same to pay and discharge all debts Legacies and charges chargeable on the same, or such dividends thereon as shall be ordered and decreed by said Court: render a just and true account of her Administration to said Court within one year, and at any other time when required by said Court, and perform all orders and decrees of said Court by her to he performed in the premises, then this obligation shall be void, otherwise it shall be and remain in full force and virtue.

      Greeting:
      Whereas Martin Gerrits late of the village of Little Chute as is alleged, died making a nuncupative Will, having while living and at the time of his death, goods, chattels, credits and estate within this county, by means whereof the granting administration of all and singular the goods, chattels, credits and estate, and also the auditing, allowing and final discharging of the accounts whereof, doth belong to us:

      Therefore, we grant unto you, the said Elizabeth Gerrits full power, by these presents, to administer and faithfully dispose of all the singular the goods, chattels, credits and estate; to ask, demand recover and receive the debts which were due unto the deceased while living, and at the time of his death did properly belong, and to pay the debts which the deceased did owe, so far as such goods, chattels, credits and estates will thereunto extend, and the law require. Hereby requiring you to make, or cause to be made, a full, true and perfect inventory of all and singular the goods, chattels, credits and estate of said deceased, which have or shall come to your hands, possession or knowledge, and the same, so made, to exhibit, or cause to be exhibited, unto our County Judge and Judge of Probate for the county aforesaid, on or before the 11th day of July A. D. 1882, and also to render a just and true account of your administration, at or before the
      expiration of one year from the date hereof; to obey all orders and decrees of the court, and also to render a just and true account of your administration when thereunto lawfully required.

      Petition for license to sell real Estate.

      In the matter of the Estate of Martin Gerrits deceased.

      TO THE JUDGE OF SAID COURT:
      The petition of Elizabeth Gerrits respectfully represents, that the total amount of personal estate that has come her hands as such executor is the sume of no dollars: that the said amount has been disposed of in paying the expense of administration, the necessary funeral expenses and a part of the debts of the deceased: that the debts now outstanding and unpaid against the estate of said deceased amount to about the sum of Two Hundred and Seventy-five dollars, as our petitioner believes: that said deceased died seized of the following described real estate besides the homestead situate, lying and being in the County of Outagamie and State of Wisconsin, to wit: North West Quarter of the South East Quarter of Section 34 -- Township 22 North -- Range 18 East - that it is necessary to sell all of said real estate in order to pay said debts and your
      petitioner would therefore pray that license be to her granted to sell the whole of said real estate, and she will ever pray.

      In the matter of the estate of Martin Gerrits deceased.
      On reading and filing the petition of Elizabeth Gerrits, Executrix; setting forth the amount of personal estate that has come to her hands, and the disposition thereof; the amount of debts outstanding against said deceased, and a description of all the real estate of which said deceased died seized, and the condition and value of the perspective portions thereof; and praying that license be to her granted to sell the North West Quarter (N W 1/4) of the South East Quarter (S E 1/4) of Section 34 -- Town 22 range 18 in the town of freedom, County of Outagamie and state of Wisconsin and it appearing, by said petition that there is not sufficient personal estate in the hands of said executrix to pay said debts, that it is necessary in order to pay the same, to sell all of said real estate; it is therefore order, that all persons interested in said estate, appear before the Judge of this Court, on the first Tuesday, being the 4th day of July A. D. 1882, at
      10 o'clock a.,. at the Probate office in the city of Appleton in said county, then and there to show case (if any there be) why license should not be granted to said executrix to sell said real estate according to the prayer of said petition.

      Order For Sale

      OUTAGAMIE COUNTY COURT - IN PROBATE.

      At a Probate Court held in and for the County of Outagamie, at the Probate Office, in the City of Appleton on the 5th day for July A. D. 1852
      Present, J. E. Harridan County Judge.

      In the matter of the application of Elizabeth Garrets, Administratrix, etc. of for authority to sell the real estate of the said Martin Gerrits, Dec'd for payment of his debts.

      Pursuant to the order of this Court made in said matter, on the lst day of June A. D. 1882 the petition of Elizabeth Gerrits praying for license to sell part of the real estate whereof said Martin Gerrits died seized, was this day heard and considered. And the affidavit of James Ryan Printer, showing that the notice required to be given by said order, has been duly published as ordered, being filed, and it satisfactorily appearing to
      the Court now here, after a full hearing upon said petition, and an examination of the proofs and allegations of the parties, find John Botteusek, special guardian of the minor heirs interested in said estate and consenting to said petition that a sale of the real mentioned and set forth in said petition is necessary for the payment of valid claims against said Martin Gerrits and the charges of said administration.

      It is ordered, that the said Elizabeth Gerrits be, and he is hereby licensed and authorized to sell the following described lands, viz: the North West quarter (N W 1/4) of the South East quarter (S E 1/4) of section 34, Town 22, range 18 - in the town of Freedom, Outagamie County, Wisconsin.

      And it is further ordered, that before making sale of said real estate, or any part thereof, the said Elizabeth Gerrits take and subscribe an oath as required by the statute in such case made and provided, and give bond to the Judge of this Court in the sum of One Thousand Dollars, with sufficient sureties, to be approved by said Judge, to account for all the proceeds of the sale, and to dispose of the same according to law.
      And it further ordered, that the said Elizabeth Gerrits shall cause notice of the time and place of holding the sale of said real estate, (in which said notice, the premises, to be sold, shall be described with common certainty,) to be posted up in three of the most public places in the town or ward wherein said real estate is situated, and to be published in the Appleton Crescent a newspaper printed at Appleton for three weeks successively, next before such sale.

      And it is further ordered, that such sale shall be held in the County wherein said real estate is situated, at public vendue, between the hours of nine o'clock in the morning, and the setting of the sun of the same day, and not after the expiration of one year next ensuing the date hereof and that immediately after the sale of said real estate, or any part thereof, the said Elizabeth Gerrits make report of his proceedings therein to this Court.

      And it is further ordered that the said Elizabeth Gerrits be and she is hereby authorized, pursuant to the statute in such case made and provided , to have or cause the said real estate to be appraised by three disinterested freeholders of said County under oath, which oaths and appraisal duly certified shall be filed in the Probate Registry of this Court, and Jacob Jansen, John Kobussen, and George Van den Huevel and hereby appointed Appraisers of the same. An if after said real estate has been duly offered for sale as hereby required, and no bid shall have been made therefor of a larger sum than that at which the same shall have been so appraised, then the same may be sold a private sale, at a price not less than such appraised value.

D. 1882, l licensing me as Administratrix, aforesaid, to sell certain of the real estate of said Martin Gerrits deceased, I did, three weeks before the day fixed upon for the sale, to wit: on the seventh day of July A. D. 1882 cause to be posted up in three most public places in the town or ward in which said real estate is situated, a notice of the time and place of such sale as by the affidavit filed in this court will appear; that I caused a like notice to be published in the Appleton Crescent a weekly newspaper printed at Appleton in said County, as by said order directed, for three weeks successively next before such sale, as by the affidavit filed in this court will more fully appear; that at the time and place mentioned in said notice, to-with: on the 29th day of July A.       Day of July A. D. 1882 authorizing Elizabeth Gerrits Administratrix with the nuncupative will annexed of the estate of Martin Gerrits deceased to sell the real estate of said Martin Gerrits, deceased mentioned and described in the said order.
      And the said Elizabeth Gerrits on the 1st day of August 1882 having made her return of her proceedings, upon the said order, by which said return, and the affidavits and memorandum thereunto annexed, it appears, that by virtue and in pursuance of the said order of license, the said Elizabeth Gerrits having given bond as required by said order, (which said bond was duly approved by the Judge of this Court,} and having taken and subscribed the oath, prescribed by the statute in such case made and provided, and having posted and published due notice of the time and place of holding the said sale, as directed by said order, and according to law, did, on the 29th day of July A.       And the said Elizabeth Gerrits having this day appeared in her own proper person, before the County Judge, and having moved for an order confirming the said sale, and no person appearing to oppose the confirmation of the said sale was legally made and fairly conducted, and that the sums are not disproportionate to the value of the said premises sold:
      It is Ordered and decreed, and this Court, by virtue and in pursuance of the statute in such case made and provided, doth order and decree that the said sale of the said real estate, so as aforesaid made by the said Elizabeth Gerrits be and the same is hereby confirmed.       Martin Gerrits, Dec’d IN PROBATE
      The Application for Elizabeth Gerrits administratrix with the will annexed of the estate of Martin Gerrits, deceased for the allowance of her final account and the assignment of the residue of said Estate to such persons as are by law and said Estate to such persons as are by law to be heard at this time; and at appearing that due notice of the time and place of hearing has been duly given as required by law and by the order of the court made herein, on the 12th day of October, A. D.1882. And after hearing the evidence, and upon examination of the accounts and vouchers of said Administratrix, the Court finds that the funeral expenses, expenses of last sickness and of administrative and the debts of said deceased have been fully paid.
      That the account properly chargeable to said administratrix is Fifteen Hundred Dollars and the amount properly allowed and credited to her is Fifteen Hundred and Fifty three & 33/100 Dollars.
      That there is due her from said Estate Fifty-three and 33/100 Dollars.
      That said deceased during his last sickness made a nuncupative will which was duly proven, allowed, admitted to probate and established as the valid will of said Martin Gerrits, deceased in said court on the 11th day of April 1882.
      That by the terms and conditions of said will all the property of said deceased both real and personal is devised and bequeathed to Elizabeth Gerrits, the widow of said deceased..
      That said deceased died seized of the following real estate, remaining unsold, to Wit: that paid parcel or tract of land bounded as follows: Beginning at a stone set in the center of the plank road leading from Little Chute to Appleton twelve chains and forty-one and a half (41 l/2) links west of the west line of the street known as Grand Avenue in the plat of the village of Little Chute as platted by John Stevens in 1850 and running thence South 45 ft West, eleven (11) chains and sixteen (16) links to a stone, thence North 59 degrees West, one (1) chain and eighty-five (85) links to an angle, thence North 72 degrees West two (2) chains and forty-three (43) links to a corner, thence North 45 feet Feast – nine (9) chains and seventeen (17) links to a stake in the center of the road aforesaid thence along the center of said road as follows: first South 86 degrees East seventy-nine (79) links to a stake, Second South 89 degrees 31 feet East, - three (3)
      chains and nineteen and a half (19 ½) links to the place of beginning centering four (4) acres of land (variation 6 degrees East), and all of lots one (1) and two (2) in Section twenty-one (21), Town twenty-one (21) North of Range Eighteen (18) East – excepting John Gerrits four (4) acres, A. Verslegins six(6) acres, A. Smits four (4) acres, J. Smits two (2) acres, A. Menlings five (5) acres, P. Nugents (3) acres, and H. Hietpas tract and part of the village plat of Little Chute - All in the county of Outagamie and State of Wisconsin.
      Therefore it is now ordered adjudged and decreed that the account of said Administratrix be and the same is hereby allowed, and the residue of said Estate, as herein – before described, be and the same is hereby assigned, heirs? fend and set over to Elizabeth Gerrits, to have and to hold to herself, her heirs and assigns forever according to the terms of the will of said Martin Gerrits, deceased.

      Know all Men by these Presents, That we Frederick Gerrits of The Town Kaukauna in said County as Principal, and Freddie Gerrits and John Lamers as sureties, are held and firmly bound unto G. L. Moeskes Judge of the County Court of Outagamie County, State of Wisconsin, and his successor in office, in the sum of Two Hundred Dollars for the payment of which sum, well and truly to be made, we hereby bind ourselves, our heirs, executors and administrators, firmly by these presents.

      Given under our hands and seals, this Fourth day of April A. D. 1895
      The Condition of this obligation is Such, That Whereas, the above named principal obligator has this day been appointed Guardian of Martin H. Gerrits and Lyda Gerrits minor heirs of Elizabeth Gerrits deceased.

      Now Therefore, If the said Fred Gerrits shall make a true inventory of all the estate, real and personal of his said wards that shall come his possession or knowledge, and return the same into the Probate Court of the proper County within such time as the judge shall order: and shall dispose of and manage all such estate according to law, and for the best interest of the wards, and faithfully discharge his trust in relation thereto, and also in relation to the care, custody and education of the wards and shall render an account on oath of the property, estate and moneys of the wards in his hands, and all proceeds or interest derived therefrom, and of the management and disposition of the same, within one year after such appointment as Guardian,
      All accounts with the Judge of Probate, or with the person having the jurisdiction of Probate matters in the proper County, or with the heirs if they be of full age, or with their legal representative, and pay over and deliver all money estate and effects remaining in his hands, or due on such settlement, to the person or persons legally entitled thereto, then this obligation to be void: otherwise of full force, virtue and effect.

      Whereas, application has been made to the Judge of our County Court of the County of Outagamie, for the appointment of a guardian to Martin H. Gerrits and Lyda Gerrits
      Minor children and heirs to Elizabeth Gerrits late of the town of Kaukauna in said County deceased, Intestate.

      And it appearing to our said Judge that Fred Gerrits of said Town and County is a fit and proper person to be the Guardian of said minors And, whereas, the appointment of Guardian in such cases may be made by said Judge, and it appearing satisfactorily that it is necessary to appoint a Guardian to said minors;

      And the said Fred Gerrits having given bond for the faithful discharge of the duties of said trust, (which said bond has been approved by said Judge:)

      Now therefore, trusting to your care and fidelity, we have appointed, and do by these presents, appoint you the said Fred Gerrits Guardian to said minors, hereby authorizing you to take and have the custody and tuition of said minors and the care and management of their charged from said trust, according to law.

      And you are hereby required according to the tenor of your bond, filed and approved as aforesaid, to make a true inventory of all the estate, real and personal, of said minors that shall come to your possession or knowledge, and to return the same into the Probate Registry of the said County Court within three months next ensuing the date of these presents: to dispose of the manage all such estate according to law, and for the best interest of said minor and faithfully to discharge your trust in relation thereto: to render an account on oath of the property, estate and money of said minors in your hands, and all proceeds or interest derived therefrom , and of the management and disposition of the same, within one year next ensuing the date of these presents, and at such other times as the said County Court shall direct and at the expiration of your trust to settle your account with the Judge of said Court or with the said minors if they shall be of full
      age, or with their legal representatives, and to pay over and deliver all the estate, moneys and effects remaining in your hands, or due from you on such settlement, to the person or persons who may be lawfully entitled thereto.

      This Agreement, Made and entered into this 26th day of October 1899, by and between G. F. Germanson of the Village of Little Chute part, and Fred Gerrits general guardian of and, acting for and on behalf of Lyda Gerrits and Martin Gerrits

      Elizabeth Gerrits, deceased, as the guardian and next friend of said infants party of
      the second part.
      Witnesseth, That whereas, the lands and premises hereinafter particularly described belong in part to said infants, and it is believed that the same ought to be sold, Therefore, if an order for the sale of said lands and premises by their Special Guardian, to be duly appointed, shall be duly obtained in proceedings duly instituted and had in the County Court of Outagamie County, Wisconsin as by the statute in such cases made and provided, the said part of the first part hereby agrees and contracts to purchase said lands and premises hereinafter described of which said infants over their undivided two eighths interest, at and for the purchase price of Seven Hundred ($700.00) Dollars, to be paid as follows, to wit: in cash upon receipt of a warranty deed signed and consented by all parties interested therein and said party of second part hereby agree to institute, or cause to be instituted, such proceedings in said Court, and use due diligence to obtain
      such order of sale therein and when obtained, to report this agreement to said Court for approval.

      Said land and premises of said infants are situated in Outagamie County, Wisconsin, and are described as follows, to wit: Beginning at the a point in plank road 193:44 west of stone at NE corner of 6 30/100 acres, known as Martin Gerrits had a surveyed by E. Spencer August 13th & 14th, 1883 and recorded in volume 3 of plat, page six: running thence 3 degree 45 feet W 245 feet 25 to stake: thence south westerly 160 feet to stake at river; thence westerly along river to stake in west line of said Martin Gerritts tract; thence North along said west line of said tract 265 feet to stone in plank road; thence north easterly along center of plank Road 525 feet 6 inches to place of beginning town of Kaukauna, Outagamie County, Wisconsin, Section 21:town 21; Range 185.

      That said infants Lyda Gerrits and Martin Gerrits are seized in fee simple absolute of an undivided two eight’s interest of the follow described real estate, lying and being situate in the County of Outagamie, and State of Wisconsin, to-wit: Beginning at a point in Plank Road, 193 94/100 feet west of stone at NE corner of 639/100 acres, known as Martin Gerrits tract an surveyed by E. Spencer, August 13 & 14, 1883 and recorded in volume 3 of Plats, page six; running thence S degree 45 feet W 245 25/100 feet to stake; thence South westerly 160 feet to stake at river; thence westerly along river to stake in West line of said Martin Gerrits tract, thence North along said west line of said tract 265 feet to store in Plank Road; thence North Easterly along center of Plank Road 525 6/100 feet to place of beginning, all in section twenty-one; town twenty-one; Range Eighteen East, town of Kaukauna, Outagamie County, Wisconsin.

      That the interests of said infants require and will be substantially promoted by a sale of all said right, title and interest in and to said real estate, for the following reasons, viz,: On account of and because (1) Said infants have no personal property and the real estate in which they own an undivided two eight interest is unproductive and there is nothing on hand to pay the debts of said infants. (2) That the interests of said infants will be substantially promoted by a sale of said premises in that said infants own but an undivided two eight’s interest in the same; that the six eight’s interest is owned by Lina Hamer, John Lamar, Minnie Lamar, Frederick Gerrits, James Gerrits who have sold their said interest in and to said deceased
      premises for the sum of $526.00 being a high price for the same, and that the purchase thereof is the same person who has agreed in writing to pay said infants $175.00 for their two eight’s interest in said premises.

      That paid infants have not been able to pay their share of the taxes levied and assessed against said premise during the past two years.

      The your petitioner is the Fred Gerrits, guardian of said infants, and as such makes this application for and on their behalf.

      Your petitioner therefor prays that John Lamers who is a suitable person therefor, may be appointed special guardian of said infants in relation to the proceedings upon this application, and required to give bond to said infants by name, to be filed with the said court, in such sum and with such sureties, and in such form, as shall be directed, and conditional as provided by statute in such cases; and that a final order may be made adjudging and directing a sale of all said right, title and interest of said infants in and to said real estate, to be made by such special guardian, in such manner, and with such restrictions as shall be deemed expedient.
      And C. H. L. Hammer and James Gerrits of Outagamie County, Wisconsin are proposed as sureties for the said John Lamers as such special guardian upon such bond.
